Applicant understands and agrees that rental of the facilities of the Hillside Park Community Center for an event is expressly subject to the following terms and conditions which, together with the Rental Application, shall constitute the Rental Agreement (“Agreement”) for the facilities between the parties hereto:

Additional Terms of Rental:

  1. Proof of Insurance: Applicant shall provide Hillside Park Community Center/AAJRB with a Certificate of Insurance evidencing in force liability coverage as follows:
    • For organization or business applicant:
      commercial general liability insurance with at least $1,000,000.00 in coverage limits, per occurrence/ $2,000,000.00 aggregate. Such insurance shall include “Hillside Park Community Center/AAJRB” as “Additional Insured Lessor”;
    • For organizations or businesses providing or serving alcohol:
      additional liability insurance shall be secured providing evidence of liquor license insurance with limits of at least $1,000,000.00 per occurrence/$2,000,000.00 aggregate. Such insurance shall include “Hillside Park Community Center/AAJRB” as “Additional Insured Lessor”;
    • For individual applicant with no homeowner’s insurance if including alcohol service:
      “special event” liability coverage, which includes general liability insurance and liquor liability insurance, with at least $500,000.00 in coverage limits.

  1. Deposit: A security deposit of $100.00 payable to the Hillside Park Community Center will be payable prior to the rental. This check will returned to the applicant within one (1) week of the conclusion of the rental, if the property is returned in a clean and undamaged per-rental condition. A visual inspection of the hall with the applicant will be done at the conclusion of the rental.
  2. Cleanup: The Applicant is responsible for returning the facilities and property to its pre-rental condition. This includes all garbage and removal of the same (garbage placed in dumpster), as well as returning tables and chairs to their original location. Applicant shall be responsible for the full cost of cleaning and/or repair thereof. The Center will not be held responsible for any property you bring into the Hall or on our Grounds.
  3. Conduct & Supervision: The Applicant is solely responsible to supervise the conduct of any person attending the event, including guests, caterers, and any entertainment. No drugs, firearms, or weapons of any kind will be tolerated during your event on Hillside Park Community Center property. The use or possession of any illegal drugs or substances is strictly prohibited. The use or possession of any firearm, weapon or ordinance is strictly prohibited. It is the Hillside Park Community Center’s sole discretion to hire a security officer or have a member attend the event, all at applicant's cost.
  4. Food: If an event requires the services of a Caterer, the Applicant is responsible for arranging their catering services and the full cost of such. Caterer must provide the Applicant and the Hillside Park Community Center/AAJRB with a copy of their valid license from the Pennsylvania Department of Agriculture.  The Hillside Park Community Center/AAJRB will not be responsible or liable for any food prepared or served during this event (including food that is not prepared by a Caterer).
  5. Alcohol Liability:
    • Applicant assumes all liability and assures the AAJRB that no individual under the age of twenty- one (21) years shall purchase, consume or possess alcoholic beverages while on the Community Center premises. Renter shall not sell alcoholic beverages while on the Community Center premises. The Hillside Park Community Center’s policy on alcohol is “Bring your own beer and/or wine”. No hard liquor is to be brought onto or consumed while on the Community Center property.
    • Any individual under the age of 21 seen purchasing or consuming alcoholic beverages will be removed from the premises with the proper authorities notified.
    • It is the policy of the Hillside Park Community Center/AAJRB to discontinue an event if we believe individuals are becoming intoxicated or unruly. Law enforcement will be contacted if necessary.
    • All individuals are responsible for themselves, however any individual who chooses to consume alcohol is strongly encouraged to refrain from driving and to designate a driver who has not been drinking as his/her only source of transportation.
    • The use of or dispensing of alcoholic beverages shall be in accordance to the laws and rules governed by the Pennsylvania Liquor Control Board and the Commonwealth of Pennsylvania.

  1. Decorations: There shall be absolutely no decorations taped or tacked to the ceiling or, walls., windows, curtain rods, curtains or light fixtures unless using Command Strips or Wall Safe tape.
  2. Release: In consideration of the rental of the facilities offered by the Hillside Park Community Center/AAJRB, the Applicant hereby releases and forever discharges Hillside Park Community Center, it’s Board, owners, affiliates, members, agents, employees, and its successors and assigns from any and all liabilities, suits, claims, and demand action or damages (including attorney’s fees and disbursements) incurred by or are in any way related to or arising out of the use or the intended use of the facilities, whether supervised or not, including, without limitation, all claims for property damage, personal injuries or wrongful death. This provision shall survive the applicants scheduled departure date/time from Hillside Park Community Center's facility.
  3. Indemnification: The Applicant agrees to indemnify and hold harmless Hillside Park Community Center, it’s Board, owners, affiliates, members, agents, employees, and its successors and assigns from any and all causes of action, claims, demands, losses and cost of any nature whatsoever arising out of or in any way relating to Applicants use of the facilities. The Applicant understands that Hillside Park Community Center reserves the right to deny access to its facilities to any individual permanently, or for a specified period of time, for any breach of Hillside Park Community Center’s policies, rules and regulations or for any conduct that is viewed as unsafe or inappropriate. This provision shall survive the applicants scheduled departure date/time from Hillside Park Community Center's facility.
  4. Assumption of Risk: The Applicant expressly states that it has read, understood and is familiar with this document and all its provisions and that it has full knowledge and extent of the risk incident to and inherent in the use of the facilities. The Applicant hereby voluntarily and knowingly assume those ricks and understands that it will be solely responsible for any injury, loss or damage, including death, which it sustains or any of its participants sustain while using the facilities and that by this Agreement, the Applicant relieves Hillside Park Community Center, it’s Board, owner, affiliates, members, agents, employees, and its successors and assigns, from any and all liability for and such injury, loss, damage or death for our use of the facility. This provision shall survive the applicants scheduled departure date/time from Hillside Park Community Center's facility.
  5. Damage: The Applicant is responsible for any and all damage to property and/or injury to persons that occur during or as a result of the event conducted during the rental. The Applicant agrees to indemnify and hold harmless Hillside Park Community Center its owner, affiliates, members, agents, employees, and its successors and assigns, from any claims, causes of action, liability, and damages asserted against the Hillside Park Community Center as a result of the Applicant’s activities on the premises of the Hillside Park Community Center.
  6. Hours: Center Hall, a rental shall be a minimum of one (1) hour which includes both setup and cleanup time. The rental hours for Hall and/or Grounds will be no later than 11:00 pm The Applicant will be ready to vacate the property at the end of the rental time stated.
  7. Use of Kitchen: Use of kitchen is not included in the above rental fee. Kitchen use will be an additional $80 to cover the salary of a supervisory staff member. Kitchen rental includes only the use of the oven, stove, refrigerator, sink, and coffee pot. The Applicant is responsible to provide all additional necessary items such as utensils, paper towels, coffee, etc…
  8. Refunds/Cancellations:
    • 90 days prior to rental – 100% of paid amount, less $50.00
    • 60 days prior to rental – 50% of paid amount, less $50.00
    • 30 or less days to rental – no refund
  9. This agreement shall become null and void if said premises are not available on the above date (s) due to circumstances beyond the control of the Hillside Park Community Center/AAJRB. Such circumstances shall include, but are not limited to: unforeseen damages to the property by other rental parties; vandalism; fire; and other acts of God, nature, or uninvited parties; or local/national emergencies (including those emergencies affecting the general health and safety of the public.)  In the event any of the aforementioned events occur and the premises become unable to occupy, the Hillside Park Community Center/AAJRB agrees to return all sums or deposits held on behalf of the Applicant.  The Hillside Park Community Center/AAJRB shall not be liable for any further damages or losses caused by the unavailability of their property due to any unforeseeable circumstances.
  10. Park Personnel: The Applicant understands and agrees that the Hillside Park Community Center is a public park facility. We may have representatives on site during your event, and these representatives have the power, and the duty, to shut down your event and notify the local police if anyone of your guests at your event becomes a public nuisance, or if they feel a dangerous situation threatens the safety of the participants or public property. The Hillside Park Community Center reserves the right to exclude anyone whose conduct becomes objectionable by our standards.
  11. Examination of Facilities/Equipment: Applicant has been given the opportunity to examine the condition of the facilities, property, and equipment and agrees that the facilities, property, and equipment are acceptable for the use for which the Applicant is renting. Applicant also certifies and knowledge that individuals utilized for its event shall be experienced and familiar in all respects with the facilities, property, and equipment and with the duties and responsibilities to which Applicant employs them.
  12. Collection Costs: In the events of Applicant’s failure to pay any amounts due and owing and AAJRB needs to pursue collection of the amounts due and owing under this Agreement, you also understand and agree that you will be responsible for the payment of the Hillside Park Community Center/AAJRB’s cost of collection of the same, including but not limited to, reasonable attorney’s fees.
  13. Drugs, Tobacco, and Firearms: Under no circumstances are drugs allowed on the property, and under no circumstances is smoking allowed in the Building of the Hillside Park Community Center.
  14. Kitchen & Game Room: Applicant shall understand that no one shall enter the kitchen & game room unless         supervised by one of the Hillside Park Community Center’s owners, affiliates, members, agents, or employees.
  15. The Applicant agrees to use the premises and facilities of Hillside Park Community Center/AAJRB in accordance with the ordinances of South Abington Township, County of Lackawanna, and other laws of the Commonwealth of Pennsylvania.

Intending to be legally bound,  I certify that  I am authorized to enter into this Agreement for the above Applicant. As the authorized agent for the above Applicant,  I certify that  I have read and accept the terms of this Agreement on behalf of said Applicant.
